  • When you leave a comment on our website, we collect, from you, your personal identifiers (name, email address) and any information you choose to provide in your comment. We use this information to respond to your comment.
  • Subscribe to our newsletter. When you sign up to receive our newsletter, we collect, from you, your personal identifiers (email address). We use this information to send you updates and editorial content. You may revoke your consent at any time with effect moving forward by clicking the “unsubscribe” link included with each newsletter we send you. 

We may also aggregate your information with other users’ data to analyze trends and improve our services, without identifying individual users.

3. Sharing Information

Bellweather Design-Build may share your personal information under the following circumstances:

  • With service providers. We share your personal information with our service providers who help us provide our services. These service providers include our marketing and advertising providers, IT/webhosting providers, customer service providers, cloud storage provider, and our payment processing provider.
  • In the event of a corporate reorganization. We will also share personal information with third parties if we undergo bankruptcy or liquidation, in the course of such proceedings.
  • With third parties. We may need to disclose your personal information to third parties, such as legal advisors, law enforcement agencies, or governmental/regulatory bodies to protect our legal interests and other rights, protect against fraud or other illegal activities, prevent harm, for risk management purposes, and to comply with our legal obligations.

We do not sell or share your personal information with any third parties for monetary consideration.

Bellweather Design-Build employs a comprehensive security program to protect your personal information from unauthorized access, disclosure, or misuse. Our security measures include:

  • Training for employees on data protection laws and security protocols.
  • Restricted access to your information to authorized personnel only.

However, no method of transmission over the Internet or electronic storage is entirely secure, and we cannot guarantee absolute security.

6. Disposal of Business Records

We retain and dispose of personal information in accordance with applicable laws and regulations. Business records containing personal information are securely destroyed when no longer needed.

7. Rights of New Jersey Residents

The New Jersey Data Privacy Act (“NJDPA”) entitles New Jersey residents to certain rights. To the extent the NJDPA applies to our processing of your personal information, you are entitled to the following rights:

  • Right to Access/Know. You have the right to request what personal information we have collected, used, disclosed, and sold about you, subject to certain exceptions. For example, if providing you this right reveals any trade secrets of ours, we may deny this request. You have the right to exercise this right once every 12 months.
  • Right to Deletion. You have the right to request the deletion of your personal information that we collect or maintain, subject to certain exceptions. For example, if we are required by law to retain the information that you are asking be deleted, we would not be able to delete the information until we are legally permitted to delete it.
  • Right to Opt Out. You have the right to opt out of the processing of your personal information for the purposes of (i) targeted advertising; (ii) profiling through solely automated decision making; and (iii) the sale of your personal data to third parties. However, we do not sell your personal data to third parties for monetary consideration. We do not have actual knowledge that we sell or share personal information of minors under the age of seventeen (17) years.
  • Right to Non-Discrimination. You have the right to not receive discriminatory treatment if and when you exercise your rights to access, delete, opt out, or correct your personal information under the NJDPA.
  • Right to Correct: You have the right to correct inaccurate personal information that we collect or maintain.
  • Right to data portability. You have the right to ask that we transfer the personal information you gave us from one organization to another or give it to you.
  • Right to Appeal. You have the right to appeal our refusal to take action on your request to exercise your other rights. In order to request an appeal to our refusal please email us at admin@bellweatherllc.com, subject line: “Appeal My Consumer Request.” We will review the appeal and notify you of our response. If we still refuse to take action on your request, you have the right to file a complaint with the New Jersey Division of Consumer Affairs in the Department of Law and Public Safety, to submit a complaint.

For requests submitted via telephone, you must provide us with sufficient information that allows us to reasonably verify you are the person about whom we collected the personal information and describe your request with sufficient detail to allow us to properly evaluate and respond to it. We will take steps to verify your request by matching information provided by you with the information we have in our records. If we are not able to verify your identity for access and deletion requests with the information provided, we may ask you for additional pieces of information.

Only you, or a person that you authorize to act on your behalf may make a request related to your personal information. If you are an authorized agent making a request on behalf of another individual, you must provide us with signed documentation that you are authorized to act on behalf of that individual. If we are unable to fulfill your consumer rights request, you have the right to appeal our decision and can do so by following the instructions in the appeals process described above.

8. Your Information Choices

You have the right to opt out of receiving promotional communications from us. To unsubscribe, follow the instructions included in our emails or newsletters. However, please note that you may still receive non-promotional, service-related communications, such as account updates or maintenance notices.

9. Log Files

Our website collects non-personally identifiable information through log files. This data may include IP addresses, browser types, and usage data, which helps us analyze trends and administer the site.
